Terms of Service

1. Who we are

Merm is a personal relationship management service operated by Richard Sage, based in the United Kingdom (“Merm”, “we”, “us”, “our”). By creating an account or using the service, you agree to these terms.

2. The service

Merm helps you track personal and professional relationships. You can add contacts, log interactions, receive email reminders, and (on the Pro plan) connect your Gmail account to automatically log emails as interactions.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. Where reasonably practicable, we will give you advance notice of material changes.

3. Eligibility and accounts

You must be at least 18 years old to use Merm. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at hello@merm.me if you suspect unauthorised access.

4. Plans and payment

Free plan

The free Starter plan is available at no charge and includes up to 3 contacts. We reserve the right to change the free plan's limits with reasonable notice.

Pro plan

The Pro plan is billed annually. Payment is processed by Stripe. By subscribing, you authorise us to charge the annual fee to your chosen payment method on the date of subscription and on each anniversary thereafter.

All prices are displayed in GBP and are inclusive of VAT where applicable.

Cancellation

You may cancel your Pro subscription at any time via the billing portal (Billing → Manage subscription). Cancellation takes effect at the end of the current annual billing period — you retain Pro access until that date. We do not offer pro-rata refunds for unused portions of a billing period.

Failed payments

If a payment fails, we will retry in accordance with Stripe's standard retry schedule. If payment cannot be collected, your account will be downgraded to the free plan and access to Pro features will be suspended.

5. Your content

You own the data you enter into Merm — your contacts, notes, and interaction logs. By using the service, you grant us a limited licence to store and process that data solely for the purpose of providing the service to you.

You are responsible for ensuring that the personal data you enter about third parties (your contacts) is handled in accordance with applicable data protection laws, including UK GDPR where relevant.

6. Gmail integration

If you connect your Gmail account, you authorise Merm to access your email metadata (sender, recipient, subject, date) to log interactions automatically. We do not read or store email body content. You can revoke this access at any time from Settings.

Merm's use of data obtained via the Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.

7. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorised access to any part of the service or its infrastructure
  • Use automated tools to scrape, crawl, or extract data from the service
  • Interfere with or disrupt the integrity or performance of the service
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the service to store or transmit malicious code

We reserve the right to suspend or terminate accounts that breach these terms.

8. Intellectual property

The Merm name, logo, software, and all associated intellectual property remain our property. These terms do not grant you any rights to our intellectual property beyond the limited right to use the service.

9. Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the total amount you paid us in the 12 months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. By using Merm, you acknowledge that you have read and understood it.

11. Termination

You may delete your account at any time by contacting us at hello@merm.me. Upon deletion, your data will be permanently removed within 30 days, except where retention is required by law.

We may suspend or terminate your account if you breach these terms, if we are required to do so by law, or if we discontinue the service. Where possible, we will give you reasonable notice.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
